These Terms of Service (“Terms”) govern your access to and use of the Number One Defender website and the purchase of products from us. By accessing this website or placing an order, you agree to be bound by these Terms.

If you do not agree, do not use the Services.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express written permission.

2. Products and Availability

All products are subject to availability. We reserve the right to modify, limit quantities, discontinue products, or cancel orders at any time without notice.

We have made every effort to display product details accurately. We do not guarantee that descriptions, images, or specifications are error-free.

3. Pricing and Payments

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change without notice.

We reserve the right to correct pricing errors and cancel orders arising from such errors, even after payment has been processed. Payment must be received before orders are shipped.

4. Shipping and Delivery (Risk Control)

  • Shipping times are estimates only and are not guaranteed

  • Title and risk of loss transfer to you once the order is delivered to the carrier

  • We are not responsible for:

    • Carrier delays

    • Lost, stolen, or misdelivered packages after carrier acceptance

    • Address errors provided by the customer

If tracking confirms delivery, the order is considered fulfilled.

5. Returns, Refunds, and Exchanges (Return Risk Minimization)

All sales are final unless expressly stated otherwise.

If returns are accepted:

  • Returns must be requested within 14 days of delivery

  • Products must be unused, uninstalled, and in original packaging

  • Customer is responsible for return shipping costs

  • Shipping fees are non-refundable

  • Refunds are issued only after inspection and approval

Products showing signs of installation, wear, or improper use are not eligible for return.

6. Installation and Use Disclaimer (Liability Control)

Products are designed for consumer self-installation.

You acknowledge and agree:

  • Proper surface preparation and installation are the customer’s responsibility

  • Improper installation, surface conditions, or misuse may result in product failure

  • We are not responsible for damage caused by incorrect installation or use

Always follow provided instructions. Use of the product constitutes acceptance of all risks associated with installation and use.

7. Warranty Disclaimer

Products are provided “as is” and “as available.”

To the fullest extent permitted by law:

  • We disclaim all warranties, express or implied

  • Including implied warranties of merchantability, fitness for a particular purpose, and non-infringement

No oral or written advice creates any warranty.

8. Limitation of Liability (Critical)

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amount paid for the product

  • We are not liable for:

    • Indirect, incidental, punitive, or consequential damages

    • Loss of use, profits, data, or property

    • Personal injury arising from improper installation or misuse

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the fullest extent permitted.

You agree to indemnify and hold harmless Number One Defender from any claims, damages, losses, or expenses arising from:

  • Your misuse of the product

  • Improper installation

  • Violation of these Terms

10. Intellectual Property

All content, designs, trademarks, logos, and materials are owned by Number One Defender and may not be used without permission.

11. Governing Law and Venue (Forum Advantage)

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any dispute shall be brought exclusively in state or federal courts located in Texas, and you consent to such jurisdiction.

12. Changes to These Terms

We reserve the right to update or replace these Terms at any time. Changes take effect upon posting.
